1. Acceptance of Terms

By creating an account or using FiveStarText (“Service”), operated by MBP Business Group LLC, you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FiveStarText provides software that enables businesses to send SMS messages to their customers requesting feedback and online reviews. The Service routes customer responses to appropriate channels based on their satisfaction rating.

3. SMS Messaging — Your Responsibilities

By using FiveStarText to send SMS messages, you represent and warrant that:

Each customer you contact has an existing business relationship with you and provided their phone number in connection with that relationship.
You have obtained all necessary consents required under applicable law, including the Telephone Consumer Protection Act (TCPA) and any applicable state laws, before sending any SMS message.
You will only send review requests to customers who have done business with you.
You will honor all opt-out requests promptly. Every message sent through FiveStarText includes opt-out instructions (“Reply STOP to opt out”). Twilio’s opt-out manager automatically processes STOP, UNSUBSCRIBE, END, and CANCEL replies.
You will not use the Service to send spam, unsolicited messages, or messages to purchased or rented phone lists.

You are solely responsible for compliance with all laws governing your use of SMS messaging. FiveStarText is not liable for any penalties, claims, or damages arising from your failure to obtain proper consent or comply with applicable laws.

4. Prohibited Uses

You may not use FiveStarText to:

Send messages to individuals who have not done business with you
Harass, threaten, or intimidate any person
Violate any applicable federal, state, or local law or regulation
Send messages that are false, misleading, or deceptive
Impersonate another person or entity
Solicit or incentivize fake, misleading, or fabricated reviews

5. Account and Billing

Free trial accounts receive 3 review requests at no charge. Paid plans are billed monthly via Stripe. You may cancel at any time; cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.

6. Limitation of Liability

To the maximum extent permitted by law, FiveStarText and MBP Business Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Service.

7. Termination

We reserve the right to suspend or terminate your account at any time if we believe you are violating these Terms, applicable law, or Twilio’s Acceptable Use Policy.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after changes constitutes acceptance.
